HugSales Terms of Service

PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. HugSales LLC. (“HugSales”/“we”/“us”/“our”) owns and operates the website located at https://hugsales.com/ and related subdomains (the “Website”), and the HugSales mobile application (the “App”). These Terms of Service (this “Agreement”) apply to all users of the Website, App, and related services (the “Service”).

You must be at least the age of majority in your jurisdiction to use the Service. By accessing or using the Website, App, or Service, you agree to be bound by this Agreement. If you do not agree, do not use the Service. If you are entering into this Agreement on behalf of a legal entity, you represent that you have the authority to bind that entity.

Arbitration & Class Action Waiver: Section 23 contains a binding arbitration agreement and class action waiver. Unless you opt out, disputes will be resolved by binding individual arbitration rather than in court, waiving your right to a jury trial and to participate in class actions.

Trials & Subscriptions: Free trial access expires automatically at the end of the trial period unless you purchase a paid subscription plan. App users purchasing through third-party app stores are subject to in-app subscription terms.

Changes to Terms: HugSales may modify this Agreement at any time. Material changes will be notified via email or in-app notification and become effective 30 days after notice for existing users (immediately for new users). Continued use of the Service constitutes acceptance of updated terms.

The Service

The HugSales service enables users to run their sales operations and customer management, including without limitation CRM, scheduling, billing, invoicing, and payment integration functions, as well as the HugSales payment processing service, all as further described on the Website (the “Service”). The underlying hardware, software, network storage, and related technology required to run the Service is provided by HugSales and its third-party vendors and hosting partners.

Your Privacy

We respect the privacy of our users. For more information please see our Privacy Policy, located at Privacy Policy and under the “Settings — Privacy Policy” section of our App (the “Privacy Policy”). By using the Website, the App, and/or the Service, you consent to our collection, use, and disclosure of personal information and other data as outlined therein.

Additional Terms

Your use of the Website, the App, and the Service is subject to all additional terms, policies, rules, product documentation, published materials, or guidelines applicable to the Website, the App, and the Service (or certain features and/or functionality thereof) that we may post on or link to from the Website, the App, or the Service (the “Additional Terms”). All such terms are hereby incorporated by reference into these Terms of Service, and may be amended from time to time by us. In the event that any Additional Terms are inconsistent with the Terms of Service, those Additional Terms will govern.
